Privacy Statement Amazing Oriental

Introduction
Oriental is a chain of supermarkets and shops located in various locations (see locations on our website) and sells products and provides services to both private individuals and non-private individuals in our stores, wholesalers and webshop. In this privacy statement, we will be referred to as “Oriental”.

When you visit one of our websites (www.amazingoriental.com or www.amazingtoko.nl or www.orientalwebshop.nl), order from one of our stores (including franchise stores) or provide us with personal information, you agree that your information will be collected, stored, used and disclosed in the manner set out in this privacy policy.

The personal data you provide to Oriental will be treated confidentially. Apart from what is stated in this statement, your personal data will not be provided to third parties, unless this is necessary for the delivery of products and/or services ordered by you or when you have given explicit permission for this.

You are not required to provide us with personal information, but if you do not provide the information we require, we may not be able to assist you or process your order. If you do not agree with the procedures described in this privacy policy, you are requested not to provide us with any personal information and to avoid interacting with our websites.

By using our website or placing an order or further providing personal information, you are deemed to have accepted the policy as set out in this statement.

1. Applicability
These regulations apply within Oriental and the franchise companies affiliated with this formula and relate to all processing of personal data of customers.

2. Definitions
- personal data: any data that can be traced back to a customer or a third party interested.
- processing of personal data: any action or set of actions with regard to personal data, including in any case the collection, recording, organization, storage, updating, modification, retrieval, consultation, use, provision by means of forwarding, distribution or any other form of provision, combining, linking, as well as the shielding, erasure or destruction of data.

3. Purpose
Personal data is only processed to the extent necessary for the purpose for which the customer provided this data to Oriental, the (optimisation of) service provision to Oriental's customers.

Oriental may use personal data for, among other things:
1. to process the customer's (future) order in the most optimal way;
2. to settle orders placed by the customer financially;
3. to maintain and expand the relationship with the customer, including by sending newsletters to customers and by informing customers of interesting offers and changes to the range within Oriental;
4. for statistical and communication purposes.

Anonymous data may be collected with a view to improving Oriental's business operations.

Personal data is processed in accordance with these regulations in a proper and careful manner and is not further processed in a manner that is incompatible with the purpose for which it was obtained.

Oriental asks the customer for consent and informs the customer about the manner in which it handles the personal data.

4. What data is collected
The personal data may consist of the following data:

  • first and last name
  • gender
  • address data
  • telephone number
  • email address
  • company name
  • location data
  • payment data (if applicable)
  • data about your activities on our website
  • ip address
  • internet browser and device type

We do not intend to collect data about website visitors who are younger than 16 years of age, unless they have permission from their parents or guardian. However, we cannot check whether a visitor is older than 16. We therefore advise parents to be involved in the online activities of their children, in order to prevent data about children being collected without parental consent.

5. Provision of personal data
Personal data will only be provided to third parties if this is necessary on the basis of a legal provision

and/or

if this is necessary for the purpose for which this information was provided to Oriental. In this context, Oriental and Oriental's franchisees may exchange your information with each other and with other parties:

  •  with our affiliated entities, suppliers and third parties who provide services to us or on our behalf (for example, third parties who process your online payments, IT management providers, third parties who provide analyses of customer orders, IT and cloud storage providers and processors, external suppliers who provide our SMS service and mailing providers);
  • if you place an order via our website, mobile website or app, the payment will be transferred via a credit card, debit card, Ideal or other medium and will be managed by a third party who provides payment services and who will confirm the payment to Oriental by providing the transaction ID and the status of the payment;
  • with any other third party who was made known to you at the time your information was collected. Or after your information has been collected and provided that other applicable requirements of data protection legislation are met.

Anonymous data may be made available to third parties for statistical and/or scientific research, provided that it serves the realization of Oriental's objectives.

Oriental concludes processing agreements insofar as these parties have no independent obligation to process personal data.

6. Data retention
Personal data will not be retained for longer than is reasonably necessary for good service provision and/or delivery of product(s).

Oriental complies with the data breach reporting obligation as described in the reporting obligation policy rules. There will be an internal procedure for handling incidents.

7. Security of processing
Oriental implements appropriate technical and organizational measures to protect personal data against loss or any form of unlawful processing. These measures, taking into account the state of the art and the costs of implementation, ensure an appropriate level of security in view of the risks involved in the processing and the nature of the data to be protected.

However, no data protection or security measure is completely secure and we cannot guarantee the security of your information, particularly when transferring it online. You must ensure that your information is protected (for example by protecting your usernames and passwords) and you must notify us as soon as possible if you become aware of any security breaches.

Oriental will use its best efforts to ensure that the information we collect and store about you is accurate, complete and up to date. However, we recommend that you inform us of any changes to your information so that we can have an accurate, complete and up to date version of your information. You are requested to inform us if you believe that your information needs to be updated or corrected. You may request access to your information and correction at any time. Such requests should be made directly to us by contacting us (see below: Contact).

8. Website and cookies
Oriental uses cookies. A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone when you first visit this website. Oriental uses cookies with a purely technical functionality. These ensure that the website works properly and that, for example, your preferences are remembered. Our cookies provide information regarding personal identification. You can set your browser so that you do not receive cookies during your visit to our website. You can send a request for access, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to info@orientalholding.com.

To ensure that the request for access has been made by you, we ask you to send a copy of your ID with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy.

We will respond to your request as soon as possible, but within four weeks. Oriental would also like to point out that you have the option to file a complaint with the national supervisory authority, the Dutch Data Protection Authority.
